Toad Ranch LLC Terms and Conditions of Sale
By accessing or using the website or placing an order with Toad Ranch, LLC, Customer acknowledges that they have carefully read these Terms and Conditions of Sale and agree to them as terms of purchase. Toad Ranch LLC reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check periodically for changes. We reserve the right to refuse service to anyone for any reason at any time or limit the sale of our products to any person & geographic region.
Although we make every effort to keep our website updated certain aspects of our design can change over time and photos may not be a representation of our current design or standard options. Please see product for current specifications or contact us and ask. Prices, products, and services are subject to change without notice.
Sales Tax Notice: All purchases made through our website are subject to applicable sales tax. Toad Ranch LLC does not currently maintain nexus in all U.S. states. If sales tax is not collected for your state at the time of checkout, you are responsible for reporting and remitting any required tax directly to your state or local tax authority, in accordance with applicable laws. > > If you are making a tax-exempt purchase or have a valid resale certificate, please contact us prior to placing your order. We are happy to review your documentation and, if approved, process your order without sales tax in accordance with state requirements.
It is the customers sole responsibility to evaluate their enclosure for safety, security and well-being of their animal(s). We are not responsible for animals escaping or responsible for fire dangers associated with any products. Please follow all Manufactures guidelines when using lighting and heating products. All lighting and heating products are installed at the customer's own risk.
Our lead time is subject to change without notice by purchasing you acknowledge this. Please see our current lead time directly before purchasing. Once your order is placed you will receive an order confirmation email with your lead time provided. Although highly unlikely orders can exceed our lead time due to supply chain issues or other issue outside of our control.
It is the customers sole responsibility to evaluate their enclosure for safety when stacking. Toad Ranch will not be held responsible for damage or injury occurred from stacking enclosures due to the high variability of weights introduced.
Due to the nature of the raw material's slight imperfections such as small scuffs, scratches, indentations, or slight marks may occasionally be present or slight variations in color, these minor imperfections are considered normal and inherent to the product. They do not affect the structural integrity, strength, functionality, or long-term performance of the panels for the purpose which it was intended. During the cutting process, we make every effort to position any small imperfections in inconspicuous areas such as the outside back panel or floor panel, whenever possible. PVC gel marks (also known as gel spots or manufacturing marks) can occur during the extrusion process of the PVC boards themselves. These are inherent to the material production and are beyond our control. Such marks are cosmetic only and do not impact the performance or durability of the panels. We cannot guarantee that your computer monitors display of color is accurate. Please order color samples if in doubt. Toad Ranch reserves the right to move or resize customer selected items and or placements at our discretion. If a customer claims placement or selection requested was a mistake it's up to Toad Ranch LLC discretion whether it is an error that merits a replacement panel or offer a partial refund (max 10% of total order value). All Destinations backgrounds are cropped & sized according to Toad Ranch LLC sole discretion. Color & resolution may vary on individual circumstances. It is Toad Ranch discretion to determine if a flaw of any kind warrants a replacement panel or partial refund (max 10% total order value). All replacement parts are the customers responsibility to install.
All Toad Ranch Enclosures are designed for indoor use only. Do not store outdoors or in direct sunlight.
We retain all right, tile, and interest, including all intellectually property rights pertaining to our website and all content thereto. You cannot use our copyrights, trademarks, without our prior written permission. You grant us permission to use your name, information of your purchase, in connection with promotions & advertisements without any compensation to you. You acknowledge that by sending Toad Ranch LLC any photo's, drawling's and design ideas it becomes property of Toad Ranch LLC. without any compensation to you.
Shipping:
It is the customers responsibility to ensure that the shipping address and phone number provided during checkout are accurate and to verify them upon receiving the order confirmation email. We may, at our discretion, allow address changes before an order ships. For accuracy and security purposes, we require all address change requests to be sent via email from the email address used to place the order. Once a shipment leaves our facility it is the customers responsibility to track and receive the item. Any attempt to alter delivery address, method or additional services that a carrier provides may incur additional fees that are the customers responsibility. If a carrier bills us for any additional charges the customer authorizes Toad Ranch LLC to charge the payment method used to place the order or bill the customer. It is important to keep in mind that outstanding balances will accrue interest on a monthly basis at a rate of 1.5% or the maximum allowable by law whichever is greater. Do not for any reason refuse delivery. In the event that the customer refuses a shipment, Toad Ranch LLC will charge the customer for the original shipping costs as well as return shipping expense. The customer will also be required to cover any costs if they opt to have the item re-shipped. If an item is returned in this manner the customer will have 5 business days to contact us to arrange for re-shipment after which the item will be considered abandoned and dealt with accordingly. Any additional fees to reship, store, any remote delivery fees etc. will be at the customer's expense. All sales are final. We will not offer a refund for undeliverable shipments, refused shipments, or cancellations. Should your item be returned to us and requires a reshipment it will be the customers responsibility to pay actual shipping cost not the discounted rate you originally were charged. Any arrangement to re-ship will be at Toad Ranch LLC's sole discretion. In no way will a refused shipment alter our return or cancellation policy.
- To keep shipping costs low, all Toad Ranch, LLC enclosures will be shipped UNASSEMBLED. All enclosures will be test assembled prior to packing and shipping to ensure proper fit and ease of re-assembly. Toad Ranch, LLC is happy to answer any questions Customer may have regarding the assembly process.
- Current lead time can be found in product description and is subject to change. We recommend checking this time immediately prior to purchasing as we update this frequently depending on order volume.
- Flat Rate shipping is calculated at checkout. In the event your shipping cost exceeds the calculated shipping cost provided at checkout It will be the customers sole responsibility to pay any additional shipping costs before we will ship the merchandise. This is extremely rare (Islands that require a ferry or other very rural areas) If this applies to you, please contact us for a shipping quote so you do not have any surprises at fulfillment.
Damage Claims or Lost Packages
We have a superb track record for packing and shipping our products! In the unlikely event that your items arrive damaged please contact us ASAP and we will work quickly to help you. All of our shipments are insured against damage.
- Unless otherwise specified in these Terms and Conditions of Sale, the carriers will not require a signature for delivery of our products. It is important that Customer is present when the package is delivered, or somebody is present who can safely receive the package on Customer’s behalf. If carrier tracking determines that the package was delivered to Customer’s address, the carrier will deny any claims for a lost package. Toad Ranch, LLC will be unable to provide a refund if a delivered package is lost.
UPS, FedEx, USPS, Etc-

If any of our products arrive damaged, you must notify us by email within 1 week of delivery or any damage claim will be forfeited.
- Please provide photos of the shipping box before opening and contents with packing material after opening as well as photos of the damage. Please be sure to hold on to the shipping box and all contents until shipping claim is complete- often the carrier wants to pickup & examine the box and all its contents. This includes all the packing cardboard, foam, etc.
Freight-
- Damage MUST be noted on the delivery receipt with the driver for any damage to be covered. If you see anything amiss with your shipment, please note it on the delivery receipt to be safe.
- Please notify us via email immediately.
- Please provide photos of the shipment and damage. Out side of box, packing material, and any damaged parts.
We will work quickly to file the claim and send out replacement parts- you will NOT fall to the end of our lead time. Replacement parts will be rebuilt and shipped out within ASAP. It is the customers responsibility to install replacement parts.
Missing Items/Order Discrepancies
Upon receiving your order, please take a moment to inspect all items to ensure that everything is in order. If you happen to discover that anything is missing, please let us know within 14 days so we can make arrangements to replace it for you.
Returns and Refunds: (excludes live animal sales)
- Items made by Toad Ranch is considered custom & are not returnable for any reason. ALL sales are final. Please make sure to ask any questions you might have and review your order before you place it. It is the customers responsibility to check order confirmation notes to ensure its accuracy.
For all items not built by Toad Ranch LLC (Arcadia, Universal Rocks, etc) returns are accepted within a period of 30 days Items must be undamaged and unused.
- Items such as lighting equipment, electronics, light fixtures, and glass bulbs are particularly delicate. Due to the fragile nature of these items, careful packing is required, leading to higher costs for labor, materials, and shipping. Returns credited back to the payment method will be in the amount of the sale less the original shipping and handling costs plus a 30% restocking fee.
- No refunds will be given for damaged or used items.
- Before any store credit is issued, returned items will be inspected upon receipt at Toad Ranch, LLC to ensure they are free of damage and in new condition. If a returned item arrives at Toad Ranch, LLC damaged, it is Customer’s responsibility to file a damage claim with the carrier. Toad Ranch, LLC will assist the Customer by providing photos of any damaged parts of the product and/or shipping container.
- It is the Customer's responsibility to pay for all return shipping costs. It is the Customer's sole discretion and responsibility to obtain and pay for any return shipping insurance.
Cancellations:
- We allow up to 24 hours to cancel orders free of charge. Quicker ship items that have been fulfilled cannot be cancelled. Items made by Toad Ranch are considered custom & after the 24-hour period are not able to be cancelled for any reason. ALL sales are final. Please make sure to ask any questions you might have and review your order before you place it. It is the customers responsibility to check order confirmation notes to ensure its accuracy.
Sales, Promotions, and Discount Codes
- Eligibility All sales, promotions, discount codes, coupon codes (including influencer/ambassador codes), and special offers are valid only on regular-priced or eligible items purchased directly through our website ToadRanchCages.com. Discounts do not apply to the following:
- Custom shopping cart enclosures
- Custom shopping cart stands or any fully custom/built-to-order products. Anything requiring a custom shopping cart.
- Previously placed or completed orders
- Bulk/wholesale orders (unless explicitly stated)
- Shipping fees (unless explicitly stated)
- Gift cards
- One Discount per Order Only one promotion, discount code, or coupon code may be used per order. Codes cannot be combined with any other offer unless expressly permitted by us.
- Non-Retroactive Discount codes and promotions cannot be applied retroactively to orders already placed or completed.
- Expiration and Restrictions All codes and promotions have an expiration date and may be subject to additional restrictions (minimum purchase amounts, specific products/collections, etc.). Expired codes will not be honored.
- Right to Modify or Cancel We reserve the right to modify, extend, or cancel any promotion or discount code at any time without prior notice, even if an order containing that code is already in progress. If a code is canceled or modified, we will make reasonable efforts to honor it for orders placed before the change when possible.
- Abuse or Misuse Any attempted misuse of codes (including sharing non-public codes, using codes on ineligible items, or creating multiple accounts to reuse single-use codes) may result in the cancellation of the order and/or revocation of the discount.
Live Animal Sales:
NOTE: YOU ARE SOLELY RESPONSIBLE FOR KNOWING ALL LAWS OF YOUR JURISDICTION THAT PERTAIN TO YOUR PURCHASE!
- Toad Ranch LLC will not for any reason knowingly violate any state or municipal wildlife laws.
- All turtles, tortoises, terrapins, and all other animals of the order Testudinata, class Reptilia sold under 4” are explicitly for scientific, educational, or exhibition purposes only.
- All animals are sold as “unsexed” unless explicitly stated. Temperature sexed will not be considered as “sexed” and not guaranteed as such. Terms such as pair, trio etc. may not indicate a sexed pair, trio, etc. If you are unsure please ask for clarification.
Live Arrival Guarantee:
- Unless otherwise specified, all animals sold by Toad Ranch LLC are covered by our Live Arrival Guarantee.
- Live animals will be shipped via FedEx Priority Overnight and will be held at a FedEx facility for pick up only. Safety of the animals is our highest priority.
- Special Requests for delivery to a residential address may be granted, but Customer acknowledges such deliveries will NOT be covered under the Live Arrival Guarantee.
- If upon receipt, the animal is deceased or if you have any concerns with your animal, you must notify Toad Ranch, LLC immediately. Toad Ranch, LLC will provide you with instructions to follow. Toad Ranch, LLC will need pictures of the outside of the box, inside of the box, and the animal. Do not dispose of the animal unless directed by us to do so. Failure to follow these instructions will void the Live Arrival Guarantee.
- Animals covered by an approved Live Arrival Guarantee claim will be replaced free of charge with the same type, species, and sex, unless unavailable, in which case store credit will be offered for the total amount of Customer’s purchase. If a refund is requested, the refund will be given in the total amount of Customer’s purchase less the cost of shipping noted on the invoice.
Electrical and Heating:
By purchasing any product from Toad Ranch, LLC with any electrical option, you agree that you are fully aware of the dangers of heating and electrical components especially in reptile husbandry and housing applications. Customer agrees not to hold Toad Ranch, LLC liable for any damage that may occur by the use of any of these products.
- All Heating & Lighting is installed at customer's own risk. Be sure to use appropriate cords etc.
- Please do your research on the risks inherent with heating reptiles. Heat lights in cages may be subject to damage by the animal please inspect them frequently. Cage furnishings should be kept clear of heating devices.
- Heating components should be controlled by a thermostat and monitored by a thermometer. Heat tape and heat cable should be used with a proportional thermostat such as Spyder Robotics Herpstat instead of a non-proportional on/off type unit and surface temperature should be checked with a thermometer.
Governing Law- These terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the state of Missouri. You agree to submit any controversy arising from these terms to the jurisdiction of the state and federal courts located in Newton County, Missouri. In the event litigation is initiated by you or us, and we prevail, you agree to pay our litigation and collection expense, including but not limited to attorney fees and court costs.Please contact us with any questions or concerns.
